Discharge of conditions 3, 8 and 9 relating to access and further site investigations have been met, so the planning is currently classed as commenced and is live. The permission granted provides for the construction of 10 holiday lodges each within approximately 1 acre of woodland. Please refer to the design document for information about the indicative design of the lodges. Lodges can be used for a maximum of 50 weeks per annum. Tenure The land is for sale freehold, with vacant possession to be granted upon completion. Access Access, which is marked blue on the sale plan, is via a field gate directly off Durham Road, Wingate. The Seller will grant access rights over the area marked in blue. Services/Material Information The land does not currently have an electricity supply or water supply so new connections would need to be made. A drainage report is available by request. Overage In the event that the Buyer or their successors in title obtain planning consent to carry out any development, that would increase the value of the land over the agreed sale amount, overage will be payable at 50% of the net uplift in value to the Seller, or their successors in title. This provision will run for 25 years from the date of purchase, and the trigger will be the implementation of planning permission, or a sale with its benefit. For the avoidance of doubt the current permission for 10 holiday lodges will not trigger any overage liability.
