A unique 1,845 acre heritage estate, including 525 acres of unenclosed open fields, producing in excess of £230,000 per annum and of significant educational and curatorial interest.

THE ESTATE
The Laxton Estate is situated in and around the picturesque village of Laxton, surrounded by rolling countryside. The village is linear and unusual in appearance, comprising 17 traditional red brick farmsteads in addition to a village pub and visitor centre. The Estate comprises 1,845 acres in total with the majority farmed under Agricultural Holdings Act (AHA) and Farm Business Tenancy (FBT) agreements. Each farm tenant benefits from a home farmstead and land let under AHA and/or FBT and a right to farm land within the open field system as administrated by Laxton Court Leet, an ancient manorial Court with legal status as a court of Law.

OPEN FIELD SYSTEM
The Laxton Estate is believed to be the only remaining English village to have retained the medieval strip farming system. The Estate tenants operate ‘in common’, using a three year crop rotation including winter wheat, a second cereal and fallow over three open fields across the Estate.

COURT LEET
For the open field system to function properly and to ensure that tenants comply with the rotation policy and strip boundaries appropriately, it is administered by Laxton Court Leet, an ancient manorial Court whose legal powers were expressly preserved by Section 23 of the Administration of Justice Act 1977.

Laxton Court Leet meets twice annually, for “Jury Day” and Court. Jury Day takes place on the last Thursday in November and is made up of thirteen members including a Foreman. There are various criteria of those that can sit on the Jury but it is believed to be anyone whom has land in the open fields.

Jury Day involves inspection of one openfield that being in wheat crop. The Jury check and re-stake the roads and boundaries of the sykes which are unfenced and note on the presentment paper any lapses or misdemeanours with a suggested fine.

THE FUTURE OF THE OPEN FIELD SYSTEM
The Laxton Open Field System and Court Leet is the last remaining example of a system of agriculture that was once common-place throughout the country, and it is therefore a significant heritage asset.

The Crown Estate acquired the Laxton Estate in 1981 and a Parliamentary Undertaking was given at that time that it would be The Crown Estate’s “intention to continue as at present organised, the Open Field System and associated customs which are the principal features of this historic Estate, and that reasonable educational facilities will continue to be made available”.

The purchaser will be required to clearly demonstrate the same intention to perpetually maintain the open field system through a positive relationship with present and future tenants and other local stakeholders.

In addition, a capacity in both organisational and financial respects to positively manage the estate in the long term must be shown, and the purchaser should ideally be able to demonstrate a track record of having successfully delivered sensitive management of the historic landscape and farmed environment at a comparable scale and complexity.

METHOD OF SALE
The Estate is for sale by private treaty as a whole.

ENVIRONMENTAL STEWARDSHIP
There is a HLS agreement in place over the whole Estate which is due to expire on the 30th September 2023. The HLS agreement is in the name of the Gaits and Commons and covers the whole Estate. The scheme is administered by the Clerk of the Gaits and Commons which receives the income from Natural England. The HLS income is shared between the tenants according to their acreage and options affecting the land in their occupation.

SPORTING AND TIMBER RIGHTS
The sporting and timber rights in so far as they are owned over the freehold of the property, are included.

WAYLEAVES, EASEMENTS, COVENANTS AND RIGHTS OF WAY
The Estate is sold subject to and with the benefit of all existing wayleaves, easements and rights of way whether public or private, specifically mentioned or not. A number of footpaths cross the estate.

BASIC PAYMENT SCHEME
The Estate has been registered for the Basic Payment Scheme and where the Basic Payment Entitlements are detailed as belonging to the landlord within the respective Farm Business Tenancy Agreements these are included within the sale. The Basic Payment Entitlements for the land subject to Agricultural Holdings Act tenancy agreements are excluded from this sale as specified in the agreements.
